Who holds the duty to manage asbestos in maintained schools?
The answer depends on the type of school. For community schools, community special schools, maintained nursery schools and voluntary controlled schools, the local authority is the employer and normally holds the duty to manage. For voluntary aided and foundation schools, the governing body is the employer, although maintenance responsibilities are often shared with the authority.
Where responsibility is shared, both parties need access to the same asbestos information and must cooperate to manage the risk.
